Mr. Twomey,
I am hoping that you would be willing to discuss the Pamela smart case with me. As you may know a documentary titled "Captivated, the Trials of Pamela Smart" was released. That documentary dealt primarily with the media frenzy surrounding the case and how it may well have caused Smart to have received an unfair trial. I am hoping to hav e a follow up documentary produced which focuses on the actual evidence in the case. I have reviewed the case thoroughly, including the entire trial transcript and am convinced beyond any and all doubt that Pamela Smart is in fact innocent.
At one point during the trial an in chambers conference was conducted and you had indicated to the court that one of the witnesses for the state had contacted your office and indicated that he had additional information that he was not asked about during his testimony. I believe that witness was Dr. Fossum and that the additional information he had was that he had found fibers somewhere within the wound to Gregory Smart's head thereby establishing that an intervening target had in fact been utilized. I believe that that intervening target was either a pillow case or towel. If correct this would of course mean that the individual who actually shot Gregg Smart had taken the time to utilize this fibrous item to muffle the sound of the gunshot. This would not have been possible for Flynn.
I he also established that Cecelia Pierce did NOT work at Papa Gino's restaurant prior to May 1, 1990. By may 1, 1990 Pierce was only 15 years old. Papa Gino's policy, in accordance with NH labor law, is to not employ any person, in any capacity who is under the age of sixteen. Thus Pierce could not have possibly worked with Tammy Robertson prior to May 1, 1990 as she claimed. Therefore Pierce's testimony that she did work with Robertson prior to May 1,1990 and attempted to have Flynn steal a gun from Robertson's car prior to the murder is demonstrably false and constituted perjury. BTW Tammy Robertson herself was only seventeen years of age on May 1, 1990 and therefore could not legally own a hand gun.
These are just a few of the things I have discovered. There is considerably more I can assure you. However, I do not wish to make this initial contact overly long.
I believe that you know in your heart that Pamela Smart is in fact innocent and I further believe that her case has "haunted" you to a degree in the ensuing years. I would very much like to discuss the case with you in greater detail with the ultimate goal being to finally prove that she is innocent and obtain the justice for her that she so richly deserves. I ask you with all due respect to help me achieve that goal.
