Hi Bill.
Bill, this is Ben Nesse.I hope time and circumstances have been good to you, Debbie and your girls as well & all are healthy and happy.
I very badly need to have a question answered. I normally ask Mark Treadup to handle any land related issues for me. He, unfortunately, is struggling badly and the last thing i would do at this time is to ask him a lawyer related question.
Bill, I am hoping you can help me. I think your special area is Criminal Law, if I am not mistaken, but my question is of a more generalized nature.
I am the victim of a completely unjust verdict by a Magistrate in Small Claims Court. Is there an ethic's board, a judge, a somebody I can go to? Since I was the Plaintiff, I cannot appeal. My issue though involves appalling unprofessional conduct by two Magistrates. 1.A totally unfair verdict, given to me by an incompetent & vindictive Magistrate, John DiSanto and a second Magistrate who covered for & protected DiSanto .This situation did start as a land related issue, illegal encroachment by an adjacent neighbor extending, without my permission, his fence 25" onto my land and then compounding that illegal action by committing another illegal action. He used his Bobcat to yank the rear property boundary marker that separates us out of the ground. His goal was quite clear: To take about 400 sq. ft. of my land by Adverse Possession. This guy is also doing the identical thing to his adjacent neighbor on the other side. Bill, the verdict and what happened afterward has left me speechless and so darn frustrated i am ready to pull my hair out. I have spent hours looking for the place I am supposed to go with circumstances similar to these, but am finding nothing. I have to believe that there is some kind of oversight. The arrogance & total lack of competency & professionalism of these two "Magistrates" is appalling. I don't know who to trust and whom not to. Even if you can just point me in the right direction, I am going to insist that I pay you, your normal fee. No breaks, okay? Thank you,
