19year old son was driving back from madison wi, pulled over and officer had Logan do field tests that went fine but, blew a .024, kept asking him if he was smoking weed, checked car , car was clean. talked to D.A. now found out loses drivers license 3months for being .004 over the .02, seems like a close margin , but maybe that's just a parent. Our son goes to college in la Crosse. Ticket due to be Paid December 27th. Thanks Tim Rau

I would like a consult but my jury trial/plea bargain in on the 31st Jan 2017.
I feel my attorney who is a public defender hasn't done much and im innocent of these charges. I just found out this week that if i go to trial, i get 6-9 months jail 3 years propation

My name is Catharin, and my son is in need of a good lawyer. His name is Michael, and he has a public defender that doesn't appear to be helping Michael. He seems nice, but as far as him representing Michael, he doesn't seem to be doing very well. I hardly hear him speak. My son got arrested for being drunk, and having his pocket knife out and extended at a bar. (which he always carries because of it's sentimentality) He left and a cop approached him, he turned, as as the court says it was extended still. (he did not pull it on a cop) Michael is near blind, he has Retinitis Pigmentosa, and he also has Nystagmus which causes his eyes to bounce around, up and down, side to side, and he also tilts his head at times because of this. Michael has to focus in on everything which takes a while, especially people and things that pop out or show up suddenly. (being intoxicated causes him more grief) He was then ordered to go to day reporting daily to get a breathalyzer, and random urine testing for drugs. He has been going, he's been put back in jail a few times when they said he was dirty. I was there a couple times when this happened and each time the day reporter lady referred to his eyes. This last time the test didn't register twice, and the cop said it was up to her if Michael should be put in jail, and she said "just look at his eyes bouncing around, you can tell he's on something" Michael said he has eye problems and she said "yeah right" I explained his eye problems, but she didn't care. Michael rarely drinks but does have a drug problem that has gotten worse since him and his wife have had problems, and then separated, (not legally yet).. Michael has talked to his public defender on a few occasions about going to rehab which he wants to do. The first time, the public defender said it would be best if Michael went to rehab on his own, that it would look good for him. We have been looking. On another occasion, his public defender said that if Michael goes to rehab before trial that there would be only one offer on the table, jail. Again we have been looking but no one so far takes his health insurance which is Forward Health Medicaid, Badgercare. This day reporting is basically setting him up to fail. Even when he shows up dirty, they test him before it's out of his system, and shows up dirty again, which lands him right back in jail. They call that bail jumping because he did something criminal therefore against the judges rules. Jail isn't easy for anyone but Michael does have a problem with it because his is claustrophobic, not sure if it's on his medical record, but he has been like that for years. Heavens, he can't even sit in the back seat of a car or van. Also he has been in many car accidents over the years, which has caused him great deal of back pain. (the beds in jail are killing him) His doctor had him pain killers, when they didn't work anymore, he went toward drugs for help. This day reporting and "bail jumping" for dirty reads whether fresh or repeats, these are causing him to get further and further in trouble, and more time in jail or prison. Matter of fact his public defender said if he gets a dirty read again, he will be going to prison. He has a problem, and like it was said in court, and not by his public defender, Michael has never been in trouble before. However because of this drunken incident, and dirty reads, he's most likely going to be put away and not see his three children grow up. Michael wants to go to drug residential rehab, but we can't afford it, insurance wont pay for it, but according to the rehabs I've spoken to, it can be mandated by the court that he goes to residential rehab, and the state pays for it. He's not hurt anyone, the drugs are hurting him, and he wants help. He won't make it in jail or prison being near blind, and with his eyes bouncing around. It will be hard in residential rehab, very challenging, but Michael wants to turn his life around. His kids mean the world to him, and he wants to be with them, around them, and drug free. Is there anyway you can help up? Is this a case you can take, and win?.

Our son is 19 , in college ,driving to Stevens point with his girl friend, pulled over , not speeding but pulled over, field tests went fine, but was drinking hours before, tested and was .024, today found out he will lose drivers license because he was, .oo4 over the .02 . Is the test that accurate ? Logan has no other tickets. Tim, timrau@charter.net
