My name is Jeff Bowen. I am assistant principal at Vidalia High School my ex-wife is an elementary school teacher at Telfair County Elementary School. I was told that I need to contact you about a situation involving my son who is a junior at Telfair County High School.

On September 9th, my son suffered a concussion while playing football for Telfair County High School. He was placed on home bound and had brain surgery (TBI) in November. He already had a 504 because of ADHD. So they failed on IDEA because they never set up an IEP meeting after 5 days of home bound. The school refused to send a home bound teacher to the house stating that they do all their home bound on computer. Even though we had doctor notes stating that he could not work on a computer. Then they told us to print off the work and read it to him whereas now he is not receiving a FAE. Three weeks after his surgery the doctor released him to work on the computer. We contacted the school and they said he had to finish all his work in 3 weeks or he would fail. His subjects were chemistry (897 assignments), ag (180 assignments), and us history (600 assignments) on Odysseewear. He could not do the work especially teach himself chemistry.
When 2nd semester started, we asked for extended time to complete the work and they gave us til the end of school. Then we finally called for a meeting with them on February 13th with and our student support advocate Mitzi Profitt. At the meeting we went over the stuff we had problems with and MItzi was appalled that they have not even started an IEP on Tyler. Their suggestion was to make him go to summer school. We said it is not right to punish Tyler because of their mistakes, that we wanted him back up to date by the end of the school year. Mind you he already had a 504 and now has suffered TBI and i shaving processing problems as dictated by a doctor.

We waited and they never got back with us to start the IEP process so we got an outside doctor to do his evaluation. The school knew we took him on a Friday then on the next Tuesday their psychologist pulls him out and begins her evaluation test then a little in to the test she stops him and says the test is invalid because he just had one thus causing more stress on my son. She then told his mother that they could not start the IEP because they have not had any RTI on Tyler and it would take 9 weeks for them to get started.

We are at our last straw with them on our SPED Director told me to get with you and see if you could help us. We are at the point where a lawsuit is our next option.
