I hope to settle this matter over the phone Jacob Robertson regarding my son Cody Jackson your client! I have been a claims adjustor for eight years and an Insurance agent another eight years for State Farm Insurance! Over the week end I spoke to Cody concerning his Personal Injury Claim! This past May, I was forced to sign a letter of resignation from Consol Energy, Shoemaker mine because I was giving an annual refresher course to another employee. We broke for lunch at around 12:10 pm and returned around 1:20 pm. We went to a Wendy's about 10-15 minutes away. Upper management said that I falsified the paper at the end of the day because I did not give a full 8 hour training. In 21 years of coal mining, the 21 annual refresher courses that I have attended, we were given two 15-20 minute breaks in the morning, 40-45 minutes for lunch, and a 15-20 minute break between lunch and the end of class. There was never any disputes. I did not know this at the time, but the person I was teaching was under investigation by the company for missing work. I was told after the fact by my immediate supervisor that he wasn't even supposed to be on company property until they talked to him. At one point, I was referred to as "collateral damage". The next day I was told to sign a letter of resignation or be fired. What I would like to know is do I have a case or not against Consol Energy and those involved?
