Hello, my dad passed away 4 years ago on March 23,2013, he did not have a will and resided in Marion NC he was 78 years old and passed at the Asheville, NC veterans hospital with cancer. I have only one sibling, my sister, Linda M. Greer, 47, whom lives in Athens, TN, and I am 50 and I am disabled and having to live at my mom's because my house burnt down 2 yrs ago, but still own 2 acres, and also my mom, 68, was staying at the rest home with my grandmother , 97, whom had dementia, and she passed away last February, and my took off and went to Tennessee to live with my sister in Tennessee while still drawing from NC, My sister makes $80,000 a year, lives in a 1/4 of million dollar home with pool and pool house, owns 4 cars, while I draw $872 and have a car payment of $210 mthly car insurance of $110 because I was involved in a auto accident last year and my expenses are to much to were I can not get a loan and my income is to low, I can not get a mobile home to put on my land. My problem is my sister will not let me have my half of what my left a checking account he had in mountain City TN, and he owned 4.4 acres of land in Athens , TN, I know my sister froze his checking account but before she did I was told he had $7000.00 and now only has $500.00 which is not fair or right but I can not pprove this, and she has his land deed to his property and I think she is trying to put it in my my mom's name illegally because she has resources and money and the right connections, and now she is telling me that I have to get out of my mom's house by April 15,the because they are selling my mom's house my grandmother left my mom because my mom is transferring he Medicare to Tennessee and if she don't sell the house she will lose everything unless she comes and stays in the house here in NC. I do not believe this, I've been taking care of my mom's house for 3 yrs since she has been gone, keeping the water from freezing, repairs, and paying have the grass cut, and now my sister kicking me out knowing I have nowhere to go, only hope I have is if my sister gives me my half of my dad's assets to buy me a mobile home to put on my 2 acres here. Is there anything I can do about my manipulative sister? I was pro se in my custody battle and have done everything I was asked to by the courts in order to resume joint custody. They brought a scared 9 year old who had obviously been directed on what to say. I found it unethical for them to do this, and I was refused the opportunity to present very valid issues in this case. I have no legal experience and feel as though I have been treated unfair due to my lack of sufficient income to provide myself a lawyer. I live in Wilkes county, is there any way to obtain a lawyer after judgement has been handed down? Obviously if you do not have representation here, it does not matter if you do everything youre supposed to do, including drug screens and employment and housing. It seems all that matters is if you have the money for someone who knows legal ease. My toddler misses his mother, and does not understand why he cant come home. I was refer to the blue ridge legal service in the phone book by the sheriffs office in wilkes county. My landlord refuses to repair my roof that has been leaking since march.And now the tiles have fallen off and the asbestos is hanging down in the bedroom and my husband who has severe rheumatoid arthritis has to try to sleep on the couch and I'm on the floor in a sleeping bag.I have looked up landlord tenant rules and obligations and by the residential agreement act she is obligated by the gs42-42 (2)law to fix my roof. But instead she wants to apply retaliatory eviction on me and my husband and wants to break the lease. She can't by law break our lease unless we as tenants pay our rent late break a no pet clause in the lease (there isn't one) or if we damage the property or participate in illegal activities such as selling drugs,by the way the landlord is aware of the man in our apt complex who along with his wife do drugs the man told my husband he is a junkie. When we told our landlord she did nothing but she wants to break our lease. I am going to need your help because I am going to take her to small claims court and Sue her for the maximum amount of $5000.
