Hello,
My fiance is in Josephine county jail on an out of county hold for a case in harney county for a driving while suspended. In February of 2017 he did almost two weeks in jail. One week here waiting to be extradited, and one week there waiting for a court case for the same case. When they released him out of harney county they told him they would put him on bench probation that would be transferred to Josephine county upon agreement of 20 hours community service and paying an $416 fine. So when he got back here he called the probation office and his probation officer, her name was Nikki (Lee I think was her last name but not positive) and she had told him yes the probation was transferred here but no records of him having to do any type of community service or pay a fine. So she said not to worry about doing it. On Christmas of 2017 (a few days ago) police entered our home saying someone from around the area we are living called 911 3 times and hung up. Him, I and our 8 year old son showed the officer our phones trying to help and show it wasn't us and he continued to ask to run my fiance's name and it came back as a having a warrant out of harney county AGAIN for not doing his community service. Actually at first they told him he was being arrested for an assault charge which did not exist. Then a PV-DWS out of county hold. I have tried to contact his attorney in charge of his case out of harney county with no response back from him. Last time he went and did time for this he lost his job, we lost our home because he lost his job, and his son was taken from us. I am now 6 months pregnant and we are getting back on our feet but if he gets transferred again to harney county and they hold him for that long over a miscommunication between the courts we are in Jeopardy of loosing everything again. We are desperate for someone to help us since his attorney won't even return a phone call to see if there is ANYTHING we can do to keep him from getting extradited over something so simple again. I believe he is also entitled to a hearing within 72 hours to let him know what is going on abd has still not had one or had one set for him. We don't have $1,000 for his bail but he is willing to make whatever agreement he needs to be released so he can start working at his new job he was suppose to start yesterday but couldn't due to be arrested on Christmas for something he was told he didn't need to do. I returned from my wife's in Thailand two weeks ago. We are retired teachers. I talked to my sister in Oakland, Monday, and she said someone had called her house and said they were taking legal action. They would not identify themselves or say what the matter was about. I live in Cave Junction near Selma, and was here last year with my wife a few months. I was trying to finish some research on movies for learning English, and went to Rogue Community College in Grants Pass, the TEFL dept. I talked to secretaries and was given emails. I emailed at the beginni;ng of the semester, and was told it was too difficult for students. I waited to the endj of the semester and tried again. A Medford Police called and a security guard from RCC called and said do not contact them. My wife was very upset by the call. I had tried to find someone in the field,going up through dept head, to vice pres, and finally after months of no repsonse emailed the president asking for that to be redressed, and saying I would write letters to editors or make complaints through all channels if the record was not corrected. The Southern Oregon Univ, and SW Oregon Com Coll accepted the survey, so I :wonder if was RCC that make the call. The other possible thing is a did a rec marijuana farm job and was insulted , and harassed. I asked the job office for a redress, or I would write letters to the editors or try to find formal complaint channels, like labor boards. These are the only thing I think ;could have caused the calll to my sister, but I wonder if there is a way to find out who called, tracing a call, and what help or action or lack of action the PUblic Defender office would recommend.
