Medical Malpractice case with which I hope you can help me:
Essentially, I had a scar on my face from acne that wasn't going away. I went to see a Nevada dermatologist whose unlicensed aesthetician "aggressively" treated areas of my face that I did not give consent to. The medical record shows that my face got zapped 41 times total even though I told technician and doctor that I have very sensitive facial skin.
I was not given proper consent (or full eye protection during procedure or aftercare instruction). I was told to sign the consent form which was not discussed with me. The form states that "possible complications of this laser treatment include scarring, hypopigmentation and hyperpigmentation" but with "no damage to surrounding tissue." The office brochure on V-beam laser states that "V beam laser treatments performed properly by a trained physician are safe and effective." I even went back to the dermatologist's technician to have her zap the one spot on my face that she missed in her "treatment" of my face, the one scar problem for which I sought help, a scar which is still present.
The office consent form states that "Photographs will be taken [for the patient] throughout the course of the laser treatment." No pictures were ever taken at the doctor's office. I, however, have my own photos of how I looked before "treatment" and after "treatment," I can state that I have new jowls, frown lines, sunken cheeks (due to medical fat loss caused by laser), indentations/wrinkles, lip shifting/contour/muscle sensation change, and marks from laser. Needless to say I look ten years older, I believe.
I returned to office several times--had a little difficulty getting some records, not all of which I have--and when I wanted the medical doctor/dermatologist to see my face for himself, he told me I could get a face lift in Reno. A face lift had never even been a part of the discussion prior to this time. But he or someone from his office then wrote down the name of a plastic surgeon in Reno that he recommended I go see.
The technician at this office states that her work wouldn't have caused my facial changes, yet I find numerous cases online of people suffering the same consequences as I had/have from this kind of laser treatment. Needless to say, my self-esteem has definitely been affected.
