We just received the court notice today and we are calling a meeting with the
board as to having to go to court to pay dues when we are in debt with stillhaving
to pay Nadeau for selling us out. We have not only kept all the letters, court documents,
everything to do with Fox RIdge, but we also have the evidence as to your
defending mcatavey & illegally billing unsuspecting owners to pay for Mcatavey's
legal expenses. We also have copies of checks written to you & will send you copies.
We have one of the owners stating that the board lied stating you were a condo
attorney, living in a condo association and performing legal work for them.
These were all lies and yet there was no effort on your part to make the truth known
to the innocent owners. Bob and I have lived in an absolute HELL because of
what Nadeau, you, and all the criminals on the board have done to us and
other innocent owners.We have copies of checks which Mcatavey issued to
himself such as charging owners $6.00 a monthfor 80 units at $480 a month
and the many months he was billing these amounts to innocent owners and
your continuing to defend him which you had a legal and ethical obligationto to tell owners the
truth of the Embezzling and criminal activities here which I have made known to the
OFfice of the Atty General & detective Berkowitz of the Investigation unit called me
as to my evidence & she is helping me with providing her with more evidence which also
includes Mcatavey & PHP being partners in these criminal acts.We also have evidence
which I submitted to her regarding criminal violations of the Fair Debt COllection laws which
you participated with Mcatavey in submitting those threatening & harassing letters to
owners stating they owed dues when their funds were being embezzled which Nadeau
repeatedly stated to you. Anyone serving as a debt collector must be licensed
by the State & Mcatavey was never licensed to collect any amounts & stated
in letters to owners that they would have a lien placed on their homes with having to
pay your legal fees. This association has operated with repeated criminal actions
& we are holding a mtg with the board & unit owners to make the truth known to them.That
bogus settlement conference which Nadeau is guilty of initiating against us was not only
illegal but both he & you violated the Maine rules of professional conduct.YOu knew the truth
but still defended Mcatavey & if we did not have the evidence to prove what we state,
Detective Berkowitz would not be working with me.I havebiopolar depression & severe
anxiety with being a patient for 23 yrs at McLEan psychiatric hospital in Belmont Mass.
I remain a patient there & I see my psychiatrist every 4-5 weeks for medication mgmt.
& therapy. My depression became such I finally told Dr. cluett that I wanted to
have an accident with my car which I would not survive & he immediately admitted
me to begin electroconvulsive shock treatments.YOu added to this hell we have had to live
with with being threatened, harassed & assaulted& this evidence is part of what we
are making known to the Bd Overseer.The evidence we have estimates the embezzled
funds to be $143,000- the other owners can attest to the fact you were never voted
by owners to be hired or paid.You also added to the owners believing we were the bad
guys here with your letters such as the one sent after that bogus conference. Not one
of the attys honored Justsice Brennan's order that lienholders had to be present at
that meeting & you had no legal right to be there & also to be paid $5000 by the ins.
company. Mcatavey, PHP & board members were embezzling funds to include
paying you & owners will attest to the fact they never voted to hire or pay you required
by law.you threatened us with stating we had better pay our dues before you get in so deep
you cannot climb out. THis again while you were defending Mcatavey & all board members
guilty of embezzling. SInce receiving this court order, we are calling a mtg of owners
which we had intended to do to make the truth known tothem & were in contact with
Detective Berkowitz re: the additional evidence we had & we have put together packets
of just some evidence of the truth as to the embezzling beginning in 1999 & going until
2012 when new owners came here & finally got rid of Mcatavey & found him to
be once again, guilty of missing funds We could not believe your repeatedly
denying us our legal right to see all records & then stating that the Blanchards
are not to be left alone with records & that we had not stapled them together in the
same place all the while we had the right to copy records & Mcatavey was embezzling
funds & why don't you read the FDCL to see what actions the ATty GEneral can take
against those violating the laws such as the superintendent demanding Mcatavey produce
records & the right of owners to a class action suit. Atty GLenn Anderson informed you
of having a Conflict of interest in defending Mcatavey which you ignored & stated
you sent a letter to the Board overseer asking them for a decision & theysent you a letter
stating they could not make a decision. Do you think anyone is going to believe this
& we are including this in our evidence to the Board as to your having to produce those letters. We have never been guilty of any wrongdoing yet Nadeau made it appear we were the
bad guys here & we intend to seek out reimbursement of all monies we had to incur
a home equity loan for & the criminals were allowed to go free from prosecution &
reimbursement to owners.Nadeau allowed them to continue embezzling for another
6 years. There is no way we are going to let all the guilty parties including attys
to be free from having to reimburse owners. I cannot believe you sent us that court order
& it exacerbated my depression & I am asking my doctor to submit a letter as to my
having to be admitted to the hospital given the HELL we have had to live in. Some of
the new owners also told us of that witch Connie stating untrue statements about us & that is
going to stop NOW. As my sister stated, if we did not have all our evidence & as
Detective Berkowitz stated, no one would believe what we have had to live with &
all the criminal acts here. What is so despicable is the fact neither you nor Nadeau
had any conscience as to what you did to us and innocent owners. Nadeau repeatedly
lied to us as to going to trial & PHP having to reimburse us but his letters will prove how
he lied and cheated us. Did you ever have any conscience as to billing owners for your
legal fees & defending the criminals here. AN owner investigated Mcatavey
being a licensed realtor & the state could not find any proof of this. We cannot take
any more of this HELL & given the fact the depression & anxiety have become even
worse, & thankfully the owners are going to know the truth NOW even though
we had planned to call a mtg after going through more of our evidence for Detective Berkowitz.
Attys take an oath to be honest & reputable but apparently you and Nadeau have forgotten
this. How you both added to the hell we have had to live with is despicable.Connie repeatedly sent threatening & harassing ltrs to us & made Bill DIx & us sell our RV's and she fined
us $25. for having a blue tarp on our RV because COnnie did not like blue tarps.
She & other board members came to our house to measure our RV & making it a rule
that no could have an Rv.we also have that asinine rule as to owners being removed
from a mtg if they spoke over 5 minutes when I went to the police captain & he called
Connie while I was at the station telling her police are only at mtgs for safety reason
The mgmt. company was never voted to be hired of paid by owners & the board
here was led to believe the way the criminals operated here, & was the way a condo association should operate. Again, no one bothers to read the laws & this has made
this association be in absolute violation of the rights of owners to live in peace
& safety. there has never been any compliance with the board & mgmt having to
honor their Fiduciary obligations. Why should Bob and I have to deal with repeated
violations of our legal rights & the owners need to know the truth & how a condo
association must operate as per the State of Maine. Nadeau stated the terms of your
apology are grossly inconsistent with what was placed on the record so where was there
compliance with anything at that bogus conference & I am sure Justice BRennan will not
appreciate his order being violated. We are asking the board tohave a mtg with us
so this entire mess can be clarified & the real criminals will be prosecuted & have to
reimburse the innocent owners. The other owners knowing the truth stated you had topay back
monies paid to you. What goes on here has to stop & this association has to operate
with the laws as stated by the STate. We are submitting evidence to the courts
regarding this entire legal action & this has added to the HELL we have to live with.The laws
state anyone owing dues is allowed a mtg to explain why they have not paid & that is
what we are demanding this be done.Everyone embezzling funds walks away free
from prosecution & reimbursement to owners but that is not going to continue which we
believe owners will be joining us in seeking legal action. We also have the atty general
taking our case which we are making known to courts & Bd Overseer.Again, our legalrights
