Dear Mr. Borges
:I was a plaintiff in a small claims court suit. I was handed down a completely , totally, 100% unjust verdict (obviously, i lost) by a " Magistrate." The verdict was so unfair I cannot calm down. Since I was the plaintiff, I cannot appeal. I have to believe that there is someone, some group, a body of some sort that oversees improper/unjust verdicts, unprofessional behavior displayed consistently by a Magistrate and total incompetency involving a significant lack of knowledge of Massachusetts Land Law.. The conduct by this Magistrate and another Magistrate who covered for him later has left me speechless and without any respect at all for the Judicial System in this state. The situation was so bad, I keep thinking that what transpired could not possibly have happened, but it did! After about the 15 minute mark of the first of three hearings/trials, I knew that despite overwhelmingly convincing evidence, I had zero chance of winning.. The three issues I so desperately need help with are: 1. The completely unjust, unfair verdict
2. The Magistrate's incredibly bold and arrogant unprofessional conduct.,
3. The Magistrate's inexcusable lack of basic Mass. Property Law.
This Magistrate only handles Mass. Prop. Law, and no other forms Civil Law as well as no Criminal Law. He is paid around $105,000 per year to get this ........
I, a semi retired history and English high teacher knew more about this area of law in fewer than 10 hours of studying than this Magistrate knew in no less than three and a half years as a Mag.. He now is in his fourth.. My first trial/hearing was on August 18, 2015.
I am curious as to how this "Magistrate" has arrived at his decisions, without knowing the fundamental laws in his only area of responsibility
It is my understanding that these hearings are recorded on DVD's (? ) and how does some like me keep them from being broken or disappearing, and I fear that may have already happened. What can be done about that too?
So i summary, I have three very corning issues: 1. Unjust verdict, 2. Unprofessional conduct (extremely), 3. Lack of fundamental knowledge clearly shown by this Magistrate and a protective type cover up by one of his peers but that's subject for another time.
There has to be a Board of Ethics, or a different type of Appeals Court or mechanism, the Mass Supreme Court or something else I can turn to. I have spent a lot of time Googling all of this with no results. I would really appreciate ANY help at all. Please keep all this confidential., I feel that you would anyway, but...... II there is no law or rule mandating the confidentiality of me making inquires, Mr. Borges, I am asking you to respect my confidentiality in this matter. This could trigger a nightmarish scenario for me., I think you understand the situation.the gravity of all of this. This recently was a Magistrate being tried for some kind of wrong doing down on the Cape or in Barnstable maybe?
Would it help or hurt me to go public right now to the newspapers with this?
I will be the first to admit that I am scared and that I am out of my league.
