Dear Mr. Aragon &/or Law Partners of Mr. Aragon;
Thank you for your time in advance. I'm currently going into my 8th year since getting my DWI, being sentenced & fully completing on time & in full the first time offenders program & everything it entailed. (Side note: I was fortunate to have a great counselor who came out of this & helped me work through the issues that kept me self medicating with alcohol, just saying good things emerged out of my situation & I don't & haven't drank in years.) Here's my problem, I hired an attorney to represent me when it happened then literally wasted $5 grand my opinion. No, I wasn't looking to beat the rap I knew I was guilty but, I at least thought he would have represented me correctly & filled my paperwork for the money I paid & the kicker is ... He never bothered to file the document for my license to be reinstated & from what I understood at that time the cost was a hundred dollars & I would have gladly given it to him or paid it directly myself had I known & what makes this even more frustrating is he never discussed this with me so, upon completing everything, I thought my license was still good at that time as it said it was good for another 3 years, so here I am stupidly assuming I've got the okay to drive again & my license is still good but, learn I'm wrong everything isn't good. I found out way after the fact on my own looking my record up & then inquiring downtown that infact my license has never been reinstated. So, these are my issues that after 8 years, & thousands of dollars I still face... I'm not sure how I go about submitting a form for reinstatement of my license to drive after all this time & is it something I can do & pay for on my own? I'm obviously going to have to take my driving test again @ 48 yrs old & apparently, even know it's been 8 years I've been informed by MVD that I will still have to have & pay for an interlock device in any vehicle I drive for the duration of a year & I have no idea what the cost of an interlock device runs plus, the upkeep & maintenance will run me & better yet here's the real issue...I ride my mountain bike & SunTran everywhere & have for years & I don't own a vehicle but, I would like my drivers license back & for my driving test I could borrow a family members vehicle but, apparently that won't work if I'm required to have an interlock in the vehicle I take my driving test in.? As I said I would like to have my drivers license should I ever want a vehicle of my own again or should I need to drive someone else's vehicle at any point. I also understand through MVD that the there's a separate license for people that drive with the interlock so, I'm guessing after 8 years & being completely sober & mistakenly thinking I've paid my dues my punishment continues...So, if a year with the interlock ever gets completed for me..? I would then have to go to MVD yet again & spend more money to get a regular drivers license a year later..? I realize nothing in life is fair & I'm not looking for sympathy or pity but for the love of God...I have more than paid my dues to society for my screw up, through the court system, out of my wallet & out of my character in becoming a better person & yet, I'm still faced with this situation going into 8 years due to something so simple that the attorney left out & honestly, to say it has become a real thorn in my side is an understatement. If you've made this far & can make sense of & understand what I'm dealing with thank you, it exhausts me to even have to write it all & I'm sure it probably exhausts you to read it due to the complexities of my situation because I don't even know where to begin to deal with it. Thank you again Mr. Aragon for offering this space to post a question even know this isn't the one you were expecting & in posting here I will hope that maybe, just maybe out of it all I will get an answer & know what direction to at least start.
Sincerely,
Victoria
Albuquerque, NM
