We, my wife and I filed Chapter 13 on or about November 2011.... it was dismissed by the court in Sept 2013.... and so far we have successfully been able to are care of our obligations..... we have been working closely with Bank of America to keep the ownership of our house ... and successfully completed the trial period of a loan modification. ...... we have recently received new loan documents for the permanent modification, these are from Dallas .... we also have received another document from the home office in Greensboro, NC..... here's the problem.... The loan mod docks front Dallas have added $67,000 in interest and fees to the base cost of the note, raising the amount total to $233,714.00, making a monthly payment of $1933.67, this was the trial payment to the note as well..... The other document from the home office in Carolina states that they have received all of our payments and that all that we owe is a back payment of $2944.75 to be caught up and the balance on the note is $164,700 on the house with a payment of $1413.13....
I have stated to our rep at B of A for the past three months that she has to come up with the full accounting from the time of the bankruptcy filing of all the payments that were made by the court.... we have documentation to support all of this from the court. .. clearly one division is not communicating with the other..... and our rep keeps telling us that she has no record of any of this..... obviously we have an accounting problem here... I have told the rep that we won't sign any docs for the mod until they produce the accurate statement for the house, but we are going to continue to pay the $1933.67 note... This way I feel that they can't come back and say that we have missed payment.
Here's the real kicker...... On January 21st my wife and children were awakened to strangers wanting to come into our home for a tour of a foreclosed property that was being sold in a month... and they had copies of notification from the Recon Trust division of B of A to support that fact..... I was on the road working at that moment and my wife and kids were completely freaked out by this.... and of course my rep at B of A has no record of anyrhing, no foreclosure, no sale, we're all qood...she said if they didn't leave for my wife to call the sheriff to have people cited for trespass. .... thus coming from a bank rep.....

The question is what do we have to do to make the bank come clean in all of this, and get this note under control? or is this just being victims to B of A's tricks and feined no knowledge of anything, and how do we fight back?
