William Abbott asked a question

To Whom It May Concern:
I am desperately in need of legal assistance. I feel strongly that I did not commit any violations, but the case is such that I cannot solve it by myself.
I have been informed that the court in San Luis Obispo has filed some type of warrant—not clear what type of warrant it is at this point- against me on a bad check charge that I thought was taken care of. Some brief history: I simply paid my commercial space landlord a check for $3500 in October, 2012, and five days later gave him cash. Due to all the turmoil at that moment, I did not get a receipt from him. Also, a parent firm I was working with at the time provided funds to the landlord to cover rents from that time until December, and I do have record and proof of those funds being paid. So, naturally, because he was angry that I was breaking my lease three years early, he cashed the original check when the account had no funds, and that made its way to the D.A. office. I did not even know any of this was happening until I was pulled over for a moving violation and they found a warrant for a misdemeanor charge. I spent one full day in county jail and then was told that I was going to have to enroll into a bad check program. My lawyer at that time, Harold Mesick informed me that I would not have to go to court and that he would take care of it. I traveled up here to Washington and was unaware of any deadlines set because I thought I had my lawyer (Mesick) showing up at the hearing. He went to my hearing, but he did not give me any information about dates for applying for the program and I forgot all about it. Apparently the courts didn’t because they filed a bigger warrant against me of which I had no idea would evolve to this point.
My biggest issue right now is that I cannot go back to SLO because I am in the middle of working on a consulting case in Vancouver. Since I was financially devastated, this is my only way of staying alive at this moment. If I lose the Vancouver job, I am basically homeless and penniless, but if this warrant stops me from going across the border, I cannot do my work. I have written some more details below, but basically I need to know: 1) Is there a public defender for me in San Luis Obispo 2) Since I do not have funds to hire a lawyer, what are my options there> 3) How do I proceed in general?
I am in need of legal assistance. Any help you can provide me would be greatly appreciated. I do have proof of paying the rent via my sister company, so the funds should apply to that rent that was due and cover that check that he said was no good.
It is extremely important for me to clear my name because I must travel a lot for my work in internationally. If I cannot travel, I cannot work.
Please help me if you can. You can reach me at this address, or at (805) 215-2305.

Thank you for any assistance you can offer.
Sincerely,

William Abbott
The following is some more background regarding my situation:
My school that I ran for 20+ years was closed by new federal legislation involving accreditation. There was nothing I could do about it, but it put me into a very compromising situation both financially and legally as many of my students who came from large agencies wanted to sue me for deposits paid for housing and past tuition and costs of moving to another city, etc. As a result, I have had not only financial issues, but legal ones as well. One of my problems is money—I have very little due to my school being shut down. However, the reason I came up here to Vancouver was to work so I can earn a little to be able to simply survive. What has happened to me is like a nightmare. The first of the chain of events was that the Government made it impossible for me to operate my school, so it had to close. On top of that, I had to pay a lot of people A LOT of money to cover for the mess left by the government. It has been a horrific one year. As I said before, I had no idea this could even happen.

Here is a timeline of what I have gone through if you need some details:
October 2012 Federal Government gave notice of closure of school—no violation and no reason except for change of law and a missed deadline
I was leasing a building from Quaglino Roofing for $3500 per month. During these months I was paying in cash and cashier checks mostly. I did write the one check but a few days later paid in cash to Quaglino. We did not have a good relationship because I was breaking my lease. He was very angry at me and he cashed the check even after I paid him in cash. Unfortunately, I cannot find the receipt. I have receipts from around that date, but I cannot find the exact payment. Everything was chaotic during that time as you can imagine as I had to shut down a school after 20+ years. ONE IMPORTANT POINT IS THAT A COMPANY CALLED GO CAMPUS WAS WORKING WITH ME AT THAT TIME AND PAID MY RENT FOR ME FOR SEVERAL MONTHS OF TIME. THAT $3500 THEY PAID SHOULD HAVE GONE TOWARD ALL RENTS DURING THAT TIME.
November 2012—As a result of the closure, I had to spend every day paying back tuition payments, housing deposits, etc. I wemt through all my resources doing this and had almost nothing to live on.
December 2012---School closed. I have my entire staff and I have been unemployed from October to present. I have attempted to restart the school, but have had not luck getting it off the ground. I ran the school for 24 years. I don’t know what else to do.
January to June---mostly attempting to reopen school---living barely on what was left over from savings and school
-during these months I was told that I had a check that was cashed, but was not told anything else by the D.A. office. During this time I also lost my home, so I had no place to get my mail. Even today I am homeless and do not have a mailbox.
I was picked up in May on a warrant for the check and spent a day in the county jail, I was told by Harold that he would go and take care of it. I know nothing about the law and how everything works, so I just forgot about it. I knew I still had a case going, but I did not know the timetable.
Suddenly I hear that there is a Felony warrant for my arrest in San Luis Obispo! I was shocked. I had no idea something like this could happen. So, I am now trying to figure out a way to get past the lack of communication up here and the lack of access to phone and computer. Also, I am still nearly broke. I also have no family that can help me. What compounds my problem is that I have to go back and forth into Canada, just to work, and I cannot afford to fly to SLO or send a lot of money for my representation. Though, I know I must defend myself and sign up for the bad check program, or whatever I have to do. I am willing to send you funds to get the process started so I can get cleared.
You can write me at this email, or call me at (805) 215-2305. If I don’t answer, it is because there is very poor reception in this forest laden area. Please leave a message and I will get back to you asap..

Sincerely,

William Abbott
