We put out home in Loudon in a Trust about 6 years ago. My husband and me, and my father and mother. We used a lawyer in W Knoxville. I just recently discovered a mistake was made. It was supposed to be me, mom,dad with rights of survivorship, and my hubby, Mike, sole and separate. The lawyer made all 4 of us with rights of survivorship. That wasn't what we wanted. We wanted my mom and dad's share to go to me when they pass. As it is, my husband also shares in that 3/4's. We were flying to Loudon yesterday, 25th, but my dad had a massaive heart attack. Now we are REALLY CONCERNED. I pulled a whole title on line last week to bring to Tn with us. Now we are delayed. Can we get this straightened on the phone or must we postpone till we are able to go home? TO SUMMARIZE: we want the trust to show me, mom, dad with Right of Survivorship. When they die, I own 3/4 of the property and my hubby 1/4. (Just so you know, we aren't trying to rip him off. My parents generously GAVE MY SPOUSE 1/4 ownership.
2. My father-in-law is Trustee, my oldest son alternate. The thing is my in-laws moved to another state, plus my father-in-law has heart problems also. Therefore, we want to make our 26 year old, single son, the new trustee.
All we are trying to do is get this cleaned up while my parents are still living. Hopefully this is clear enough.
